Warranty Conditions

 

Aerofoils GmbH provides a 2-year warranty on the product advertised with the following warranty promise. The period for calculating the warranty begins on the date of the invoice. The geographical scope of the manufacturer's warranty extends to all areas where Aerofoils GmbH actively sells.

If during this period material defects or manufacturing defects occur in the goods you have purchased, the manufacturer, as the guarantor, will grant you one of the following services at its discretion within the scope of this warranty:

  • Free repair of the goods, or
  • Free replacement of the goods with an equivalent item

Exclusions from the warranty:

Statutory Warranty (Guarantee)

1. Statutory Rights
Customers have statutory rights in the event of defects in the goods. These rights are not limited by the following provisions.

2. Cases in which, as a rule, no warranty claim exists
A claim under the statutory warranty for defects generally only exists for defects that were already present at the time of delivery of the goods. As a rule, no such claim exists if the alleged defect or damage is due to:

normal wear and tear commensurate with age and use during intended use;
improper or abusive handling of the product, i.e., use in a manner exceeding its intended use (in particular: a battery cover torn off due to opening beyond 90° or stiff hinges);
failure to observe safety, maintenance, or operating instructions, and the defect is attributable to this;
significant force was applied beyond normal wear and tear (e.g., severe physical damage from blows or impacts, falls, crushing);
unauthorized repair or modification attempts by the customer or third parties, and the defect is attributable to these attempts;
harmful environmental influences, such as... B. extreme heat, high humidity, intense UV radiation, or corrosion resulting from prolonged improper use or storage (e.g., prolonged storage in a damp and unventilated environment with high salinity).

3. Specific, non-exhaustive examples of signs of use (not generally considered defects)
Notwithstanding the above provisions, the following appearances, in particular, generally do not constitute a warranty claim, unless they are attributable to a defect that already existed at the time of delivery:
Changes to EVA pads and board handles, including normal discoloration or fading due to sunlight or UV exposure,
Adhesive residue on inflatable boards, provided it does not impair the board's function,
Creases, creases, or pressure marks on inflatable boards caused by folding, packaging, or storage that do not impair their function,
Damage to inflatable boards caused by contact with pointed or sharp objects, e.g., Examples include rocks, shells, broken glass, sharp-edged jetties, or shoreline areas.

The above examples are not exhaustive. The decisive factor is always whether the reported defect is due to a fault that already existed at the time of delivery or to a subsequent cause attributable to the customer.

Additional conditions:

  • Replacement or repair is only carried out in the country of the original delivery.
  • The customer is responsible for all shipping costs, customs, and shipping outside the EU.
  • To keep the warranty valid, an obligatory service inspection must be conducted after 12 months.
  • A repair or replacement does not extend the warranty period.
  • The warranty is valid for 2 years for private use. For commercial use, the warranty is valid for 2 years, but it only covers the functionality of the product and excludes any claims related to its appearance or cosmetic condition.

Warranty claim procedure:

  1. Contact Information: To initiate a warranty claim, please contact Aerofoils GmbH at the contact details provided above.
  2. Inspection by the guarantor: The guarantor must have the opportunity to check the warranty case (e.g., by having the goods sent in). Please ensure the goods are securely packaged to avoid damage during transport.
  3. Required documentation: A copy of the invoice must be enclosed with the shipment so that the guarantor can verify that the warranty period has been complied with. If the invoice copy is missing, the guarantor may refuse the warranty service. If the seller’s name and address are not indicated on the invoice, you must provide this information.
  4. Shipping costs: In the case of a justified warranty claim, the shipping costs for the return shipment will be covered by the guarantor. If it is necessary to disassemble the goods for a fee to send them to the guarantor, the guarantor will bear the necessary costs for disassembly.

Important note:

This manufacturer's warranty does not restrict your statutory rights in the event of defects, and you can make use of them free of charge. Any existing statutory warranty rights towards us remain unaffected by this warranty promise. This warranty promise from the manufacturer does not infringe upon your legal rights but rather expands your legal position.

If the purchased item is defective, you can always contact us within the scope of the statutory warranty, regardless of whether there is a warranty claim or whether the warranty is invoked.
