General Terms and Conditions for Participation in the Sweepstakes of the Company "Aerofoils GmbH" ("Organizer") and the
Participating Customer ("Participant")

These conditions of participation regulate the conditions for participation in the sweepstakes as well as any necessary transfer of rights. The description and the procedure of the respective sweepstakes shall be made within the framework of the respective sweepstakes campaign on the homepage of the organizer www.aerofoils.de/zeitgeist. 

The organizer of the competition is Aerofoils GmbH, Brauneckweg 14, 85748 Garching.

With the participation in the respective competition these conditions of participation are accepted.

Participation in the competition of Aerofoils, hereinafter referred to as
the organizer, is free of charge and is governed exclusively by these
conditions of participation.

To participate in the competition, it is necessary to fill in and send the
participation form.

Participation is only possible within the participation period. Entries
received after the closing date will not be considered in the draw.

Participation in the competition is possible from 01.05.2023 (00:00 hours) to 07.07.2023 (24:00 hours).

Within this period, users will be given the opportunity to participate in
the sweepstakes.

Eligible to participate are natural persons who have reached the age of 18. Participation is not limited to customers of the organizer and is not dependent on the purchase of goods or services.

Should a participant be limited in his legal capacity, the consent of his
legal representative is required.

All persons and employees of the organizer and affiliated companies
involved in the conception and implementation of the sweepstakes as well as the relatives of such employees and their relatives are not eligible to participate in the sweepstakes.

Participation with forged identities or with identities of third parties is
not permitted.

Only one submitted entry per participant will be eligible to participate in the Sweepstakes. It is strictly prohibited to use multiple addresses or profiles to increase the chances of winning.

In addition, the organizer reserves the right, at its own discretion, to
exclude persons from participation if there are justified reasons. Such reasons exist in the case of:

• Manipulation in connection with access to or implementation of the
  competition,
• violations of these terms and conditions of participation,
• unfair trading or
• false or misleading information in connection with participation in the
  competition.

If the excluded participant is a winner who has already been drawn, the
prize may be subsequently withdrawn.

Among all eligible participants we will draw the following prize:

An Audi e-tron Foil from Aerofoils. The prize includes the board itself,
the drive, the wing(s)/stabilizer(s), the battery, the charger, and the
associated board & drive bag.

The winner will be determined by a random drawing among all participants on 07/31/2023.

The participant who is the winner of the draw will be informed of the prize
in a timely manner via a separate e-mail.

The prize will be handed over exclusively to the participant who has won or to the legal representative of the legally incapacitated participant. An exchange, a transfer, a self-collection as well as a cash payment of the prize are not possible.

Any costs incurred for shipping the prizes will be borne by the organizer.

The risk is transferred to the participant when the prize is handed over to a transport person. The organizer is not responsible for delivery damages.

Additional costs associated with claiming the prize shall be borne by the participant who has won. The participant who has won is responsible for any taxation of the prize.

If the participant who has won does not report after two requests within a
period of 3 weeks, the claim to the prize expires. In this case, the organizer is entitled to conduct a substitute draw and then transfer the prize to another participant.

Only one prize is possible.

The organizer reserves the right to prematurely terminate the competition in whole or in part or to change its course at any time, even without observing deadlines and without prior notice or notification of reasons, if it is not possible for technical reasons (e.g. computer virus, manipulation of or errors
in software/hardware) or legal reasons to guarantee the proper and scheduled execution of the competition.

Participation in the competition requires the provision of personal data (first name, surname, e-mail address, date of birth). The participant assures that the personal data provided by him/her, first name, last name, e-mail address and date of birth are true and correct.

The organizer is responsible for the collection, processing, and use of
personal data of the participants. The organizer will use the participant's personal data and other personal data only in accordance with the legal provisions of data protection law. The organizer points out that all personal data of the participant will neither be passed on to third parties nor given to them for use without their consent.

The organizer will only store, process and use the information to the extent that this is necessary for the implementation of the competition or if the participant has given his/her consent.

The following declarations or consents are not required for participation in the competition.

If consent is given, please read carefully, mark with a cross and sign to declare consent and/or acknowledgement.

The participant may revoke his/her declared consent at any time. The
revocation is to be made by phone call, e-mail, on the homepage of the
organizer or in writing to the organizer.

After revocation of the consent, the collected and stored personal data of
the participant will be deleted immediately. The revocation of consent does not affect the lawfulness of the processing carried out based on the consent until
the revocation.

The participant has the right to object at any time to the processing of personal data concerning him or her for the purpose of direct marketing; this also applies to profiling, insofar as it is associated with such direct marketing. The objection is to be made by phone call, e-mail, on the homepage
of the organizer or in writing to the organizer.

If the data subject objects to the processing for direct marketing
purposes, the personal data will no longer be processed for these purposes.

Questions and complaints in connection with the sweepstakes should be
addressed to the organizer.

The lottery of the organizer is exclusively subject to the law of the
Federal Republic of Germany. Legal recourse is excluded.

If any provision of these Terms and Conditions of Participation is or
becomes invalid in whole or in part, this shall not affect the validity of the
rest of these Terms and Conditions of Participation. In place of the invalid provision, the legally permissible provision that comes closest in economic
terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Terms and Conditions of Participation.
